Terms of Service

Effective 17 June 2026 · Agent Café (402.coffee, api.402.coffee)

1. What this is

Agent Café (402.coffee) is a public HTTP endpoint implementing the x402 payment protocol on the Base network — a trust layer for agent payments providing three services: (a) certification, where a paying agent pays a small amount of USDC to test and certify how it pays and receives a machine-readable certificate and README badge; (b) a paid risk score, where a counterparty pays to receive a deterministic score of a wallet's observed payment behaviour (§10 does not apply; this is not credit, investment, or safety advice — see §8); and (c) an escrow arbiter service (§10). It also exposes novelty "coffee" routes that take a real payment the same way. Certificates, scores, coffees, barista lines, and badges are digital items — there is no physical product, and no result is a guarantee of any party's future conduct.

2. Acceptance

By sending a request to the Service or making a payment, you agree to these Terms. If you don't agree, don't use the Service.

3. Networks (testnet vs mainnet)

The Service may run on a test network (Base Sepolia), where payments use valueless test tokens, or on Base mainnet, where payments use real USDC. The current network is shown on the site and at /status and /inspect. On testnet, data and balances may be reset at any time.

5. Acceptable use

You agree not to: use the Service for any unlawful purpose or with unlawfully-obtained funds; attack, overload, probe, or disrupt the Service; circumvent rate limits or security controls; or use it in violation of any applicable sanctions or laws. We may rate-limit, block, or refuse requests at our discretion to protect the Service.

6. No warranty

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, availability, or uninterrupted or error-free operation. We do not guarantee uptime, latency, settlement success, or freedom from bugs, and we are not responsible for failures of third parties we depend on (hosting, database, the blockchain, and the x402 facilitator).

7. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of funds, profits, data, or goodwill, arising from your use of the Service. Our total liability is limited to the amount you paid to the Service in the 30 days before the claim.

8. Not financial advice; not a financial service

The Service sells access to a digital novelty and receipt. Nothing here is financial, investment, legal, or tax advice. We are not a bank, exchange, broker, money transmitter, custodian, or regulated financial institution, and we do not provide any such service.

9. Public data and the wall

Blockchain transactions are public by nature. The public "wall" displays the settlement transaction, a truncated wallet identifier, and a café-given nickname derived from the paying wallet. Barista lines and nicknames are auto-generated by us; we do not display text you submit. See the Privacy Policy.

10. Escrow arbiter service

The escrow arbiter (/escrow) is an automated dispute-resolution service for x402r delivery-protection payments. By routing a payment through our operator contract or integrating our arbiter endpoint, you accept the following: (a) we never take custody of funds — escrowed amounts are held by the on-chain AuthCaptureEscrow contract, and the arbiter can only release funds to the receiver named in a payment or refund its payer; (b) verdicts are automated determinations of machine-verifiable delivery facts under the published policy version at /escrow — they are not legal arbitration, not a guarantee of quality, and not insurance; (c) our 1% fee is bound inside each payment's on-chain terms and deducted at release; (d) if the arbiter does not act, payers may self-refund after the escrow window — we are not liable for funds held during that window or for gas costs of any party; (e) we may decline to arbitrate any payment that does not carry our published fee terms, in which case it auto-refunds per the contract. Sections 6–8 (no warranty, limitation of liability, not a financial service) apply in full to the escrow arbiter service.

11. Changes

We may update these Terms or the Service (including prices, items, and the network) at any time. Continued use after a change means you accept the updated Terms.

12. Governing law & contact

These Terms are governed by the laws of South Africa. Agent Café is an independent project operated by the operator of 402.coffee; it is not a registered company and nothing here implies one. Contact: hello@402.coffee.
